Tolbert and Oliver v. Monsanto (Claims Administration)
In 2003, Ed gentle was was appointed Claims Administrator of the Tolbert Qualified Settlement Fund, www.TolbertQSF.com, with 18,500 claimants in the Monsanto PCB global settlement in Anniston, Alabama. The firm is designing a claimant payment matrix and will be conducting the biggest PCB blood test in history. It is currently issuing $500 advance payment checks to all claimants.
Breast Implant Litigation (Litigation Support)
Since 1994, Ed Gentle has served as Escrow Agent for all Breast Implant MDL 926-Qualified Settlement Funds, providing accounting, business and tax support.
Gentle Turner & Sexton has issued over 360,000 checks totaling more than $1 billion in direct payments to breast implant claimants.
As the Interim Financial Advisor for the Settlement Facility-Dow Corning Trust, Ed Gentle is charged with overseeing the investment of the Trust’s funds, which currently total over $1 billion. Gentle Turner & Sexton also provides tax and accounting support to the Trust.
Owens v. Monsanto (Litigation Support)
In 2001, the Firm was selected to provide claims payment and administration services for the settlement of a PCB-related action against Monsanto in Anniston, Alabama—with approximately 1100 plaintiffs. Gentle Turner & Sexton has been given authority to administer the settlement with adult and minor claimants. In addition to the primary task of preparing and distributing checks, the Firm also helps resolve claimant-related issues.
State of Alabama — Proration
During a December 2001 Special Session of the Alabama Legislature, Gentle Turner & Sexton represented the Governor of Alabama and the State Finance and Revenue Departments in the successful drafting, lobbying and passage of a $160 million tax package to prevent education proration.
State of Alabama — Tax Code Revisions
In 1999, the Firm advised the State of Alabama’s Senate in the drafting, passage and implementation of key legislation taxing businesses in the State—in order to make up for a $120 million per annum shortfall created by the nullification of Alabama’s corporate franchise tax as violative of Federal law.
Comptronix Class Action (1991-1995)
From 1991 to 1995 Ed Gentle defended the Chief Financial Officer of Comptronix Corporation, in a class action alleging accounting misrepresentations to the Securities and Exchange Commission and investors—and the artificial creation of $26 million of income.
Divestiture of AT&T
In 1983 and 1984, Ed Gentle advised AT&T concerning the mechanics of its tax-free Divestiture into Regional Bell Operating Companies and AT&T Communications and Information Systems—including the resource sharing and planning of the survivor entities; obtaining federal tax approval for the transaction; and obtaining state regulatory approval in Alabama, Mississippi, South Carolina and Tennessee.
